Stuart Rouse Photography Privacy Notice

In accordance with EU GDPR (General Data Protection Regulations) we hereby state our privacy notice, effective 25th May 2018.
We will treat your data in the same way that we would wish our own personal information to be treated. This notice explains how we use any personal information we collect from you through our website, through third parties and in person at promotional events.


Collecting your information

Your information, including your name, telephone number and email address will only be collected by us with your consent. Your information may be collected in person (on promotional materials including but not limited to competition entry forms) or via competition entry or promotion application forms on our website.
In some cases, such as sign-ups with our GDPR-compliant third party partners (including Emma’s Diary and Your Baby Club) you have already expressed consent to those parties for your information to be passed on to a local photography studio in your area to which Stuart Rouse Photography has been assigned.


Using your information

We’ll use your personal information to contact you regarding our photographic services that you have expressed an interest in. We undertake this processing because it is necessary to take steps to enter into a contract with you. 
If you agree to receive email updates, we’ll use your name and email address to send this information to you. By sending this information to you, we are pursuing our legitimate interest to provide you with information regarding our products and services. You have the right to object or restrict to this processing at any time, just let us know (see the Contact section below), or click on the unsubscribe link at the bottom of the email. We promise not to bombard you with information or irrelevant offers.
We use Mailchimp to send our newsletters. Please see Mailchimp‘s privacy notice for further information.
We also use social media providers to notify you of special offers and promotions.
As copyright holders of all images, we reserve the right to store and use your images indefinitely for the purposes of the business including but not limited to marketing, website and promotional materials.


Who else receives your personal data?

We may share your personal information with third parties only where it is necessary for our working relationship, or where we have another legitimate interest in doing so. Your personal information is never passed on or sold to other parties or companies for marketing purposes.
As a full-service photography studio, we may transfer your image data to third parties (photographic laboratories, framers and/or printers) to produce and manufacture photographic items including but not limited to framed images, wall art, albums and photobooks.
We may transfer your image data to third parties operating or managing our website on our behalf, to third-party payment providers, third-party social media prodivders, and third-party mailing providers. Those third parties may be located in countries (typically the USA) outside of the EU (see section below). By submitting your personal data, you agree to this processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this notice.
Your images may be stored online via a personal password protected image gallery. Where we have given you or where you have chosen a password which enables you to access your online image gallery, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
In order to conduct our business and fulfill our contract with you, and to protect images against loss, corruption or for replacement purposes your personal data and/or photographic images may be stored and/or backed up securely locally and/or in the cloud in several locations simultaneously.


Transferring your data outside of the EEA

By using third-party providers, we transfer some of the personal information we collect about you to the USA in order to perform our contract with you. Some of these providers are registered with the EU-US Privacy Shield. This means that these providers have been deemed by the European Commission to provide an adequate level of protection for your personal information. For those providers we use who are not registered with the EU-US Privacy Shield, separate consent will be required by you at the time of your portrait session.


How long will we keep your personal data for?

We’ll keep hold of your data during the period we provide our service to you plus six years from the end of the last company financial year they related to, in order to comply with UK company record keeping requirements. As copyright holders of all images, we reserve the right to store and use images indefinitely for the purposes of the business including but not limited to marketing, website and promotional materials. 


Your rights to your personal data and complaints

You’re entitled to know what personal information we hold about you and how that information is processed, which means you can ask us to do any of the following things:
  • to access your data;
  • to rectify any mistakes relating to your data;
  • to erase your data;
  • to stop processing your data;
  • to receive an electronic copy of your data;
  • to object to our processing of your data;
  • to object to any automated decision making that we may do using your personal data; and
  • (automatic) to receive a notification of any breach of your personal data.
